Prior to divorce, plaintiff (wife) discovered that husband had signed her name on a contract to purchase new truck. She was not aware that he was purchasing the truck, nor that he had signed her name on the contract. The truck was put in her namd and his and financed through GMAC. She secured a copy of the contract from the dealership and a clear copy of the signed contract from GMAC. It is clearly his handwriting. Another incident: Upon learning that she had filed for divorce, he secured a Beneficiary Designation Form (dropping her as primary beneficiary). Her attorney advised her not to sign until the divorce was final, which she did. Then she learned that he had secured another form, signed her name (had to be signed before a notary), and submitted it to his company. Is this forgery? What action, if any, can be taken?
